The web page located at travel.zooming.ca and all linked pages together form the “Site”. Your use of the Site is expressly conditioned on your acceptance of the following terms and conditions as well as our privacy policy found here. By using the Site, you are specifically agreeing to be bound by the terms and conditions outlined herein together with any other written or verbal information we bring to your attention before your booking is confirmed (the “Terms”). If you do not agree with any part of the Terms, please do not use the Site.

For good and valuable consideration (including, without limitation, the mutual covenants and agreements of these Terms), the user (“you” or "Customer") accepts, without modification, the Terms as set out herein, and to any terms and conditions of the air carrier, hotel, car rental company, tour operator or other travel services supplier (each a "Travel Services Provider") which are applicable to the travel services being purchased by the Customer from the Travel Services Provider. When making your booking, we will arrange for you to enter into a fulfilment contract with the Travel Services Provider. Your booking will be subject to these Terms, and any terms and conditions of the Travel Services Provider. The Customer acknowledges having had the opportunity to review the terms and conditions of the Travel Services Provider prior to completing the purchase of any travel services through the Site.

Customer’s use of this Site in any manner, including browsing, activating an account or making a purchase, constitutes the Customer’s acknowledgement that they have read these Terms and agree to follow and be bound by these Terms. By using this Site you agree to these Terms and Conditions, as written and outlined on this page for this Site. By using this Site you also consent to the terms laid out in our Privacy Policy. You also acknowledge and confirm that you agree to the terms and conditions of the respective Travel Services Provider providing the travel product you are purchasing (e.g. vacation packages, flights, hotel reservations, cruise packages, etc.). The rules and regulations (or any terms & conditions) for a Travel Services Provider are made available during the booking process via a featured link to their terms. We reserve the right to modify or change these Terms at any time without prior notice to the Customer. The Customer’s continued use of the Site shall be construed as the Customer’s acceptance of any such amendments. It is Customer’s responsibility to review the Terms carefully each time the Customer uses the Site.

1. Conditions of sale

We is the "Agency of Choice" selected by the Customer. In providing travel information, making reservations and issuing tickets and other documents to the Customer, we act solely as the agent for the Travel Services Provider. We do not guarantee the travel services to be provided by any Travel Services Provider. We assume no responsibility for actions beyond our control in connection with travel services. We are not responsible or liable for any claims, losses, damages, costs or expenses arising out of personal injury or death, loss of enjoyment, upset, disappointment, distress or frustration, loss of or damage to property, accident, delay, non-performance, irregularity, or any consequence from them, which may be occasioned through the neglect or default or any act or omission of any Travel Services Provider or any governmental authority or which may be occasioned through weather, equipment failure, labour disputes, sickness, theft or any other reason not within our direct control. Without limiting the generality of the foregoing, we are not responsible for any incidental, special, punitive or consequential damages whatsoever.

We transmit the proceeds from the sale of travel services to the Travel Service Provider supplying those travel services thereby acting as the Travel Service Provider's agent. If a Travel Service Provider defaults prior to providing the travel service for which Customer has made payment, the Customer's sole recourse for refund is with the defaulting Travel Service Provider, or by filing a claim through Customer’s insurance, if such insurance was purchased and / or covers the default in question. Customer should review the Travel Service Provider’s terms and conditions for further information.

We disclaim all liability for errors or bias in reservations, fares, or other information provided by any automated airline reservation system.

When travelling abroad, all Canadian citizens (including children) must carry a valid Canadian passport with an expiry date no sooner than 6 months after the scheduled date of departure from the last country visited, regardless of the entry requirements of the country. If your passport is damaged in any way, you may be denied boarding and will be responsible for all costs associated replacement travel arrangements and/or a new passport.

Entry to another country may be refused even if the required information and travel documents are complete.

You and anyone travelling with you should check with the airline directly for check-in or cut-off times as the airline’s suggested timings are guidelines only and are subject to change without notice. Please ensure that you take the time to review the invoice/itinerary that we provide you to ensure that it is correct and reflects your requested travel arrangements.

2. Your responsibility

By making your Booking through our Site, you understand that:

  • You are responsible for ensuring that the spelling of all names is correct and corresponds exactly to how they appear on your passports. The exact spelling will appear on your ticket(s) and vouchers.
  • Any fees, levies, service charges, taxes or other charges are 100% non-refundable. Any price changes in the products purchased will not affect the amount of the invoice and no monies will be credited or debited unless changes to bookings have occurred.
  • The living standards and practices at the destination as well as the standards and conditions there with respect to the provision of utilities, services and accommodation may differ from those available in Canada.
  • It is your responsibility to be aware of and prepared for all legal, documentary, health and other requirements for your intended travel. Such requirements may include, but are not limited to, a passport, visas, tourist cards, affidavits for travelling with minor children, and any vaccinations that may be required for entry into the destination. Please contact the local Embassy of your travel destination and your airline for information on the specific documentation required.   • All travellers will be required to present a valid passport for either air, land or sea travel to the United States. Driver’s license, birth certificates, provincial health cards, etc., will not be accepted by U.S. Border Agents. Passports must be valid for at least 6 months after return to your home destination.
  • Travel services purchased from us are provided by third parties with their own terms and conditions of sale and in particular, but without limitation, those terms and conditions pertaining to cancellation. We have no control over, nor bear an liability for, nor should be construed to endorse the terms and conditions of third party suppliers.
  • We are relying on your confirmation that as the booking or instructing passenger, you have the legal capacity and authority to purchase travel products and services on behalf of yourself and any other persons named in your invoice or itinerary, and that you will keep us informed of any changes to your travel plans or contact information.

3. Our responsibility

  • We will use reasonable care and skill in the selection of the providers whose products we offer to you. We will be responsible for the acts or omissions of our employees or agents acting properly on our behalf within the scope of their employment or agency, but will not be responsible for the acts or omissions of other persons. OUR LIABILITY WILL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCTS WE HAVE SOLD TO YOU IN ANY CIRCUMSTANCES.
  • Any travel product or service purchased from us also results in a contractual relationship between you and the Travel Services Provider.
  • If you encounter dissatisfaction with the travel product or services purchased from us and provided by a particular Travel Services Provider, please follow the following process:
    • If you encounter a problem during your holiday, please inform the Travel Services Provider immediately.
    • If your complaint is not resolved locally, and you wish to complain further, please notify us of the same within 28 days of your return and we will assist you as best we can in resolving any issue with the Travel Services Provider.
    • WE WILL NOT ACCEPT ANY LEGAL RESPONSIBILITY OR LIABILITY FOR ANY PRODUCT OR SERVICE FAILURES ON THE PART OF THIRD-PARTY PROVIDERS AND WE ASSUME NO RESPONSIBILITY FOR ANY CLAIMS, LOSSES, DAMAGES, COSTS OR EXPENSES ARISING OUT OF ANY PERSONAL INJURY, ACCIDENT, DEATH, LOSS, DAMAGE, DELAY OR LOSS OF ENJOYMENT CAUSED BY ANY THIRD PARTY PROVIDER OR ANY OTHER PERSON BEYOND OUR CONTROL.
    • For more information regarding the terms and conditions governing the contractual relationship with the Travel Services Provider, please consult their website and/or brochures.
  • WE WILL NOT BE LIABLE FOR ANY DAMAGES DUE TO ILLNESS, THEFT, LABOUR DISPUTE, ACT OF GOD, MECHANICAL BREAKDOWN, EQUIPMENT FAILURE, QUARANTINE, RESCHEDULING, GOVERNMENT ACTION, WAR, INSURGENCY OR ACT OF TERRORISM OR OTHER EVENTS BEYOND OUR CONTROL.
  • Some hotels may charge a local tax or extra fee, which you must pay locally at the hotel upon check-in or check-out.
  • Price increases are not permitted after the customer has paid in full. If you are a resident of Ontario and your deposit has been processed, you have the right to cancel your contract and obtain a full refund in the case that the price of services increases by more than 7% (unless resulting from an increase in government taxes or a fuel surcharge allowed by the Canadian Transportation Agency).

4. Special requests

Should you have a special request, including but not limited to, required wheelchair accessibility, preference of room location or hotel views, or strict dietary restrictions, you must advise us at time of booking. Special requests cannot be guaranteed by the Travel Service Provider or by us. While the Travel Services Provider will attempt to accommodate such requests, we cannot be held responsible if special requests are not fulfilled. Additionally, failure to meet any special requests will not constitute breach of contract by us. Please inform us at time of booking of any special service needs and requirements due to medical conditions and/or disabilities.

5. Credit card payment

Authorization to use your credit card (either through our web site or over the phone) constitutes acceptance of these Terms and any terms and conditions of sale of the Travel Services Provider(s). The foregoing authorization is your confirmation that you will pay the total amount charged for the products and services purchased according to your cardholder agreement and not charge back your payment. Notwithstanding the foregoing, the Travel Services Provider(s) may require the cardholder to present the credit card used at booking, at check-in. Failure to do so may result in the requirement to purchase a new product or service.

A booking, or any pricing viewed on our Site, is not guaranteed until the credit card payment is processed and the booking is confirmed. Certain Travel Services Providers do not accept credit card as form of payment for a flight ticket purchased, in which case you may have made a separate booking with us directly for the relevant flight.

In the event that the credit card holder is not also one of the passengers travelling, a Third Party Credit Card verification process, including the completion of an appropriate Third Party Credit Card Form along with the presentation of a passport and driver’s license, may be required.

We act as a retailer on behalf of the Travel Services Provider(s). Therefore, in some instances, the Travel Services Provider’s name will appear as the vendor on your credit card statement rather than ours.

6. Cancellations, changes and refunds

Cancellation or amendment of a booking may be subject to additional fees, such fees to vary and be determined by the Travel Services Provider who will be providing the booked travel services. In many cases, the price of travel services is 100% non-refundable and / or may be accompanied by an applicable cancellation fee. The booking or any travel arrangements made under the booking, may not be changeable or may be changeable only upon payment of a fee to be determined by the Travel Services Provider. The Customer should consult the terms and conditions of the applicable Travel Services Provider before completing the booking.

We are not able to provide refunds for unused travel services or any portion thereof, nor is the price or value of unused travel services exchangeable for any other travel products or services. Any changes made to your current booking will be subject to the terms and conditions imposed by the Travel Services Provider(s). Travel insurance may protect you in certain circumstances and we encourage you to purchase the appropriate travel insurance coverage for protection.

We reserve the right to apply an administrative charge not exceeding $50.00 plus applicable taxes for cancellations or changes to bookings in addition to any charges imposed by the Travel Services Provider.

7. Baggage restrictions

Restrictions on carry-on baggage are regulated by Transport Canada. For updated information on these or other Government of Canada security requirements, please visit the Canadian Air Transport Security website at http://www.tc.gc.ca or http://www.catsa-acsta.gc.ca or phone 1-888-294-2202.

Restrictions on baggage may be changed at any time and without notice by the Government of Canada or by authorities at your destination. UNLESS INSURED, ALL BAGGAGE REMAINS AT THE OWNER’S RISK THROUGHOUT THE TRIP.

8. Deposit bookings /early booking bonus

The full purchase price for the booking is required to be paid prior to the due date specified on your reservation. Five days prior to the specified due date, one of our Travel Advisors will be in contact with you to obtain your credit card information again so that final payment can be processed, as we do not store any of your credit card data on file. If there is an Early Booking Bonus date, one of our Travel Advisors will be in contact with you three days prior to such date.

If we attempt to make contact with you and you do not in turn contact us to process the final payment, we will not be held responsible should payment not be processed prior to the required due date and the Travel Services Provider cancels your booking. Please note that all deposits are non-refundable and, in the event that final payment cannot processed prior to the specified due date, the Travel Services Provider reserves the right to cancel your booking and retain all deposit monies paid by you.

9. Hotels and car rentals

For prepaid hotel accommodation, the following conditions apply:

  • Any incidental charges will be assessed directly to you by the hotel upon check-out. Rates are based on double occupancy, unless otherwise noted. Charges for extra persons (including children) may apply and must be paid directly by you to the hotel.
  • Any changes to or cancellations of a reservation may result in cancellation charges or change fees ranging from a minimum of $25.00 to the total amount of your stay.
  • No refunds for unused nights, including those resulting from delayed check-in or early check- out, will be given.
  • Guests must be at least 18 to 21 years of age (depending on jurisdiction) at time of check-in (depending on individual hotel policy) unless accompanied by a parent or guardian.

If car rentals are included, please note that in certain jurisdictions, a minimum age requirement may be imposed for purposes of car pick-up and rental. Please check with the car rental company directly for the minimum age requirement at the pick-up destination, as a failure to meet the minimum age requirements may result in your car rental request being denied.

10. Travelling while pregnant

For travellers who have entered their 32nd week of pregnancy, we recommend that you obtain a letter from your doctor stating (i) that the pregnancy is uncomplicated, (ii) the expected date of delivery, (iii) that you are in good health, and (iv) that (in their medical opinion) there is no reason why you cannot fly. We also suggest you contact the airline in advance of flying to confirm the regulations as outlined in their policy. In addition, many cruise lines will not accept passengers who have entered or will enter their 24th week of pregnancy by the beginning of, or at any time during the cruise. A physician’s ‘Fit to Travel’ note is required prior to sailing, stating how far along (in weeks) your pregnancy will be at the beginning of the cruise. We recommend you visit the cruise line website prior to sailing to confirm the regulations as outlined in their policy.

11. Travel insurance

Government health insurance plans may only pay for a portion of, or may not cover any of, the expenses incurred for emergency out-of-province hospital or medical services. Your booking may also be 100% non-refundable. We recommend that you purchase trip cancellation and / or medical assistance insurance to insure yourself against the risks associated with such cancellations or medical emergencies. Please contact us to speak with a representative regarding the purchase of travel and medical insurance.

12. Airport check-in / seat selection / change in flight time

The Customer is responsible for timely airport check-in and boarding within the timeframe specified by the Travel Services Provider and/or airline. We are not responsible for any repercussions faced by the Customer for failure to meet airline or airport deadlines, including but not limited to, missed flights or costs incurred by the Customer therefrom.

For non-reserved seating, seats are allocated on a first-come, first-served basis. While times may vary by airline, generally speaking, all passengers should arrive at the airport at least three (3) hours prior to flight departure, with check-in closing one (1) hour prior to departure. For security reasons, all passengers must be present for check-in, and you will not be allowed to board, nor will you be entitled to a refund, if you have not checked-in by the minimum time requirement as stipulated by the airline.

All flight times, carriers, equipment and itineraries are subject to change by the Travel Services Provider, with or without prior notice. If we are made aware of a change by a Travel Services Provider, we will use commercially reasonable efforts to notify you of any changes to departure times, by email delivered to the email address associated with the booking. For air travel, please contact the applicable airline 24 hours prior to departure to reconfirm flight times and flight status. In the event of a flight delay related to weather, traffic or another force majeure situation, it may not be possible for the air carrier to provide meals and/or accommodations. We have no control over changes implemented by a Travel Services Provider and are not responsible for lost wages, missed holiday time or any other additional charges incurred as a result of itinerary changes imposed by the Travel Service Provider or from force majeure situations.

13. Departure taxes

Some destinations charge a departure tax which is collected from all passengers upon check in for their departure flight from the local airport. The Government of Canada website travel advisory section contains details of any such taxes payable under the heading “Entry/Exit” for each destination. We suggest that you check for relevant information related to your destination at the following link: https://travel.gc.ca/travelling/advisories.

14. Special considerations for children travelling with parents

For travel within Canada, children under 18 years of age must present a birth certificate, health card, passport or other government issued photo identification to be able to travel.

For travel outside of Canada, children must be in possession of a valid passport. If a child is traveling with only one legal guardian, a notarized letter is required granting permission for the child to travel with one guardian, except where the guardian has sole custody of the child and proper documentation of such can be provided. The age at which a person is considered a child varies from country to country. Please review the requirements of the country you are travelling to if (i) you are travelling alone with a child under 18, or (ii) traveling with a child for whom you are not the legal guardian.

15. Children travelling alone – unaccompanied minors

It is your responsibility to review, and ensure you are in compliance with, the applicable laws and documentation requirements of the destination country and the return country, as they relate to unaccompanied minors.

You should also contact the airline directly regarding services available for unaccompanied minors. It is the parent’s responsibility to contact the airline directly to let them know their child will be travelling alone and to review all details concerning travel for unaccompanied children prior to arrival at the airport.

16. Duration of stay

Please note that the number of nights is based on the travel dates and not the hotel check-in or check- out dates. In certain circumstances involving odd durations, some hotels may require an early check- out and the hotel may charge additional fees for any later check out. Please refer to the Travel Service Provider’s website for full details.

17. Prices & Currency

Prices displayed on our Site are in Canadian dollars unless otherwise noted. Some charges may be processed in a foreign currency by the Travel Services Provider. In these cases, please be aware that posted prices which include foreign currency exchange are approximate amounts only until the transaction has been processed and charged to your credit card.

Airport fees for airports that require payment on site, where applicable, are not included in the pricing. All prices are subject to change without prior notice. We are not responsible for any fluctuation or changes in pricing that may occur before, during or after a purchase as a result of a change implemented by a Travel Services Provider. We are not responsible for a change in schedule, equipment or accommodations in connection with any travel service that occurs before, during or after the purchase of the travel service. Space may be limited and prices on pending bookings are subject to changes. Vacancy, accommodations, and ticket prices will only be reserved and confirmed once payment for the booking is received by us in full and the transaction is completed. All travel services are subject to availability and are deliverable to residents of Canada only.

All informational content, such as hotel and destination information on this Site is provided only as a guideline and may not be an exact representation. Hotel and destination images as well as information on this Site are representational only and cannot be guaranteed to be completely accurate.

18. Ticket & E-Document

Prior to departure and provided your Booking has been paid in full, you will be sent any documents required to the email address associated with the Booking. If for whatever reason you cannot access your email address or are having difficulty with viewing your documents, please contact us for assistance.

We recommend that you contact the airline at least 24 hours prior to departure and on the day of your departure for any schedule changes and confirmation of your flight time(s).

Please contact us if you have not received your E-Documents within 48 hours of departure and we will be happy to resend.

19. ELIGIBILITY

The Customer must be at least 18 years of age and a resident of Canada in order to be eligible to purchase travel services through the Site. By using this Site, Customer represents that Customer meets these eligibility requirements, and acknowledges that we are relying on this representation.

20. Waiver

Any waiver by us of the strict observance, performance or compliance by the you of any portion of these Terms and any extension of time or other indulgence granted by us, either expressly or by course of conduct, will not alter, affect or prejudice any of our other rights or remedies and will be effective only in the specific instance and for the purpose for which it was given, and will not be deemed to be a waiver of any of our rights and remedies arising in respect of any other breach of these Terms. No delay or omission by us in exercising any right or remedy hereunder will operate as a waiver of that or any other right or remedy.

21. Jurisdiction and Applicable Law

These Terms shall be governed by and construed in accordance with the laws of the province of Ontario and the laws of Canada applicable therein.

Customers may only use this Site to make legitimate reservations or purchases and shall not use this Site for any other purposes, including without limitation, to make any speculative, false or fraudulent reservation or any reservation in anticipation of demand. The Site and the content provided on the Site, including the text, graphics, button icons, audio and video clips, digital downloads, data compilations and software, may not be copied, reproduced, republished, uploaded, posted, transmitted or distributed without our prior written consent and/or any Travel Service Providers and distributors, except that the Customer may download, display and print the materials presented on this Site for their personal, non-commercial use only. Any rights not expressly granted herein are reserved.
  2. Booking Process – when and how a confirmation email is received? – this is something that should be consistent across all websites so customer service agents only have one policy to remember
  3. Independent Contractors - Airline carriers, hotels and other suppliers providing travel and other services on this website are independent contractors and/or suppliers and should not be construed as agents, employees or representatives of Serefin. Serefin is not liable for any acts, errors, omissions, representations, warranties, breaches or acts of negligence of any such Travel Services Provider or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom. Serefin has no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure or other causes beyond Serefin’s direct control and shall have no responsibility for any additional expenses, omissions, delays, re-routing or acts of any government authority or directed by applicable law or court order.

  5. Notices: Any notices required or permitted hereunder shall be given:
    • If to Serefin, via email to: legal@serefin.com
    • If to Customer, at the email or physical address provided by Customer during the booking process.
    • Such notice shall be deemed given: upon personal delivery; if sent by electronic mail, upon confirmation of receipt; or if sent by certified or registered mail, postage prepaid, three (3) days after the date of mailing.
  6. Severability and survivability: If any provision, or portion of a provision, in these Terms ashall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions. Customer and Serefin agree to substitute for such provision a valid provision which most closely approximates the intent and economic effect of such severed provision. Notwithstanding any other provisions of this these Terms, or any general legal principles to the contrary, any provision of these Terms that imposes or contemplates continuing obligations on a party will survive the expiration or termination of these Terms.
